We would like to take this opportunity to explain how we protect your data and what it means for you when you use our personalized services. What is personal data?

Relevant personal data is information that can be assigned to you individually. Examples include personal details (name, address and other contact details, date and place of birth and nationality), identification data (e.g. ID card data) and authentication data (e.g. signature). In addition, this may also include order data (e.g. payment order) and data from the fulfillment of our contractual obligations and information about your financial situation (e.g. financial proof in the context of a Russia visa).

What sources and data do we use?

We process personal data that we receive from you as our customer or from other data subjects as part of our business relationship. In addition, we process - to the extent necessary for the provision of our services - personal data that is legitimately transmitted to us by other companies of DVKG Deutsche Visa und Konsular Gesellschaft mbH (e.g. ÖVKG Visa und Konsular Gesellschaft mbH) or by other third parties (e.g. inviting companies) for one or more specific purposes.

Persons whose personal data is transmitted to DVKG Deutsche Visa und Konsular Gesellschaft mbH by third parties will be sent an electronic notification to the e-mail address provided, stating i) which person has carried out the processing and ii) direct access to the data protection declaration of DVKG Deutsche Visa und Konsular Gesellschaft mbH.

What do we process your data for (purpose of processing) and on what legal basis?

We process personal data in accordance with the statutory provisions, primarily the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG)

1. on the basis of your consent (Art. 6 para. 1a GDPR)

We process personal data that we have received from you for the performance of the contract with you. If you have given us your consent to process personal data for specific purposes, the lawfulness of this processing is based on your consent. Consent to the processing of personal data is given for one or more specific purposes. The consent given can be revoked at any time. This also applies to the revocation of declarations of consent given to us before the GDPR came into force, i.e. before May 25, 2018. The withdrawal of consent only takes effect for the future and does not affect the legality of the data processed until the withdrawal. Please address your revocation to:

However, we must point out that orders that are in the application process and are canceled due to revocation of consent cannot be executed any further.

2. for the fulfillment of contractual obligations (Art. 6 para. 1b GDPR)

The processing of personal data is carried out for the provision and procurement of consular services as part of the execution of our contracts with our customers or for the implementation of pre-contractual measures that are carried out on request. The purposes of data processing depend primarily on the specific product (e.g. visa application, legalization, A1 application, immigration) and may include, among other things, needs analyses and consultations.

Who receives my data?

Within DVKG Deutsche Visa und Konsular Gesellschaft mbH, access to your data is granted to those departments that need it to fulfill our contractual obligations. Service providers and vicarious agents employed by us may also receive data for these purposes. These are companies in the categories of consular services (e.g. procurement of invitations, translations), IT services, logistics, printing services, telecommunications, consulting and sales and marketing.

With regard to the transfer of data to recipients outside DVKG Deutsche Visa und Konsular Gesellschaft mbH, as a consular service provider we are obliged to maintain confidentiality about all customer-related data. We only pass on information about our customers if this is required by law or if this is necessary for the fulfillment of the contract. Under these conditions, recipients of personal data may be, for example:

  • Consulates / embassies. We would like to point out that third countries are also countries for which there is no EU adequacy decision and with which there is no data processing regulation

  • Companies for the procurement of invitations. These companies may also be based in third countries outside the EU. We would like to point out that third countries are also countries for which there is no EU adequacy decision and with which there is no regulation on data processing.
  • German authorities (e.g. Federal Office of Administration (BVA), state government, Chamber of Industry and Commerce)
  • Logistics service providers that we use to fulfill our contractual obligations.
  • Partners in the credit card business (e.g. AirPlus, American Express). However, we would like to point out that your credit card data (i.e. identification and payment data) is not collected and managed by DVKG. The credit card management (payment service) is provided by the company Computop Wirtschaftsinformatik GmbH, Schwarzenbergstr. 4, 96050 Bamberg, Germany, e-mail: info@computop.com, and (acquirer) Concardis GmbH, Helfmann-Park 7 65760 Eschborn, Germany, e-mail service@concardis.com.
  • Service providers that we use within the scope of contractual obligations.
  • Other data recipients may be those entities for which you have given us your consent to transfer data. We use your contact details and email address to provide you with information about your visa application process. We use your e-mail address to inform you about relevant changes to visa regulations and our own services. Should you wish to use another communication channel, please let us know.
  • Important note

    These recipients use your transmitted data exclusively on their own responsibility and in accordance with the law applicable to them, not unlike in the case of analogous requests. We would like to point out that third countries may often be countries with lower data protection standards than within the EU, for which there is no EU adequacy decision and with which there is no regulation on data processing.

    Will data be transferred to a third country or an international organization?

    Data is transferred to bodies in countries outside the European Union (so-called third countries) if

    • It is necessary for the execution of your orders (e.g. procurement of an invitation)
    • It is required by law (e.g. reporting obligation under tax law)
    • You have given us your consent
    • .

    We would like to point out that third countries may often be countries with a lower standard of data protection than within the EU, for which there is no EU adequacy decision and with which there is no regulation on processing for handling data.

    How long will my data be stored?

    We process and store your personal data for as long as this is necessary for the fulfillment of our contractual and legal obligations. If the data is no longer required for the fulfillment of contractual or legal obligations, the following deletion concept applies:

  • Order data and information related to the individual order will be automatically and completely deleted after 4 years. However, you have the option of independently saving the orders for a longer period for a fee.
  • Profiles of the traveler are written to after 4 years without usage activity. The profile owner has the option of deleting or maintaining their profile. If deletion is chosen, the profile and the associated orders and requests will be completely deleted.
  • Owners of user accounts will be contacted after 4 years without usage activity. The user account holder has the option of deleting or maintaining their user account. If deletion is chosen, the user account and the associated profiles of travelers, orders and requests will be completely deleted.

We would like to point out that the deletion of data may be restricted by statutory retention obligations (e.g. §14b para. 1 sentence UStG), which we have to observe. In this case, the data concerned will be blocked, i.e. only used to fulfill legal obligations. In addition, courts, law enforcement authorities or other legally designated authorities may retrieve data or request information on a legal basis.

What data protection rights do I have?

Every data subject has the following rights if the legal requirements are met:

  • the right of access under Article 15 GDPR,
  • the right to rectification in accordance with Article 16 GDPR,the right to erasure in accordance with Article 17 GDPR,
  • the right to restriction of processing in accordance with Article 18 GDPR,
  • the right to object pursuant to Article 21 GDPR and
  • the right to data portability under Article 20 GDPR

The restrictions under Sections 34 and 35 BDSG apply to the right to information and the right to erasure. You can withdraw your consent to the processing of personal data at any time. This also applies to the revocation of declarations of consent that were given to us before the GDPR came into force, i.e. before May 25, 2018. Please note that the revocation only takes effect for the future. Processing that took place before the withdrawal is not affected.

Is there automated decision-making?

We do not use fully automated decision-making in accordance with Article 22 GDPR to establish and conduct the business relationship.

Notes and special features of the website

Security, SSL technology

The DVKG has taken technical and organizational measures to protect your personal data, in particular against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. These security measures are continuously adapted in line with technological developments. The transmission of personal data between your computer and our server is always encrypted (SSL procedure, Secure Socket Layer).

Cookies

When you visit our websites, we may arrange for information to be stored on your computer in the form of a "cookie". "Cookies are small text files that are copied from a web server to your hard disk. Cookies contain information that can later be read by a web server in the domain in which the cookie was issued to you. Cookies cannot execute programs or place viruses on your computer.

Only session cookies are used which are necessary to keep your visit consistent, i.e. to ensure that, for example, no new login is required and that your preferences or other information already entered during the application process are retained during the session. In addition, we need session cookies to ensure that a specific service that you have clicked on is assigned to your request.

No tracking cookies, such as Google Analytics, a web analysis service of Google Inc. ("Google"), are used.

You have the option of accepting or rejecting cookies. The majority of web browsers automatically accept cookies. However, you can usually specify in your browser settings that cookies should be rejected. If cookies are rejected, you may no longer be able to use some functions of the website. If cookies are accepted, you can delete the accepted cookies at a later date. If you delete the cookies, all settings controlled by these cookies will be deleted and may not be able to be restored.
