The question of whether the service provided by DVKG constitutes commissioned data processing within the meaning of the General Data Protection Regulation (GDPR) must be answered in the negative. It is a service to be provided independently. In contrast, commissioned data processing is only understood under data protection law to be activities that are carried out independently under the guidance and full direction of the client; the subject of such contracts is data processing as such (classic examples: Computer center services, document destruction, printing, enveloping, franking and delivery of letters, etc.). For DVKG, however, the processing of data is only a subordinate means to an end, which is to apply for the issuing of visas, A1, EU registration and legalizations and to take all the necessary steps to obtain them. This is the typical case of independent processing as a controller. This requires the transmission of the personal data required for visa, A1, EU registration and legalization. This transfer is permissible if it is necessary for the fulfillment of the contract concluded with the DVKG (Art. 6 para. 1 lit. b GDPR).
