New Chinese data protection law comes into force
    24/08/2021 12:00

The Chinese Data Security Law (DSL) is intended to regulate data activities and improve general data security.

After being passed on June 10, the Chinese Data Security Law (DSL) will come into force on September 1, 2021.

The Chinese Data Security Law (Data Security Law, DSL) is intended to regulate data activities and improve general data security. The law adds another layer to the complex legal system, not least because it not only applies to electronic and non-electronic data activities within China, but also has an extraterritorial component. This means that, in principle, cross-border data transfer and activities abroad are also affected if the People's Republic of China considers its economic interests and national sovereignty to be infringed. Failure to comply with the law will result in administrative penalties and fines for both companies and their representatives.

As was the case after the introduction of the Cybersecurity Law of 2017, the law develops the concepts of „key data and important data“ and „strict security measuresßand thus indicates that further, more concrete regulations such as a "catalog of important data" will follow. Companies are advised to familiarize themselves with the contents and regulations of the law as soon as possible and to take the resulting measures promptly. The AHK China has prepared a practical leaflet with the most important regulations and initial recommendations for companies and is happy to provide further information at any time.
